ACCEPTANCE

Your use of the website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers set out below (``Terms and Conditions``). You should read them now. Your use of the website constitutes your agreement to the Terms and Condition.
Using this Website indicates that you accept these terms and conditions together with our Privacy Policy, regardless of whether or not you choose to register with us. If you do not accept these terms and conditions, do not use this Website.

Hoana Boutique reserves the right to amend the Terms and Conditions at any time and without notice to you. Your continued use of the website after any amendment becomes effective constitutes an agreement by you to abide and be bound by the Terms and Conditions, as so amended.

CAPACITY

By placing an order through our site, you warrant that:

• You are legally capable of entering into binding contracts;
• You are at least 16 years old; and,
• You are resident in one of the Serviced Countries.

SERVICE AVAILABILITY

We accept orders from specific countries. These restrictions can be found on our Delivery page here.

CONTRACT

After placing an order, you will receive an e-mail from us acknowledging that We have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to availability and acceptance by us, and We will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the ``Dispatch Confirmation``). The contract between us (``Contract``) will only be formed when We send you the Dispatch Confirmation
We will not process your order until payment has been received in full.
As soon as you place your order, we start to process your order which means you will not be able to change it before delivery, but you may be able to return your Products under our Returns Policy
The Contract will relate only to those Products whose dispatch We have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
We are entitled to refuse any order made by you for any reason.
When making a request you undertake that all details you provide to us requesting goods or services are true and accurate, that you are an authorised user of the credit or debit card used to make your request and that there are sufficient funds to cover the cost of the goods and services. It is your responsibility to inform us of any changes to these details as soon as possible.

ORDERS

Any order placed by you in the manner described in this website is an offer by you to purchase a particular product for the price (including the delivery and other charges and taxes) specified in this website at the time you place your order on these Terms and Conditions. Once an order is processed it can not be cancelled. Hoana Boutique reserve the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order. Your contract with us only comes into existence when it forwards confirmation of receipt of your order and payment.

PRICES

Prices of products and services and delivery and other charges displayed on this website are current at the time of issue, but may change at any time and are subject to availability.

TAXES

Prices displayed on this website are inclusive of VAT applied at the rate of 22%.

Hoana Boutique will retain title to the products you order until you have made payment in full for those products, but all risk in the products will pass to you upon their delivery to or collection by a postal or courier service. You should consider whether to obtain any suitable insurance.

RETURNS

The circumstance in which we are obliged to make a refund or return is detailed in our Returns Policy.

RETURNS POLICY

- Items must be return within 14 days of delivery date.
- Customers who have received product/s with a manufacturing fault or incorrect item, will receive a refund. (Note- Hoana's Warehouse undertake strict quality control on every item prior dispatch & upon receiving return).
- Please take due care when trying on any product/s. (Item/s manually defected/ that does not comply with our returns policy will be declined/ returned).
- Hoana is not responsible for return shipping costs.
- We do not issue Store credit or refund on additional shipping fees.
- If you purchased your items using a discount code, your refund will be the final amount you paid for that item (minus the discount).

RETURNS - RECEIVED A FAULTY ITEM?

- Not to worry! If you have received a faulty Item, please email our Customer Support team (within 5 days of receiving package) via contact form here to be instructed what to do PRIOR Shipping your return.
- Be sure to use a traceable delivery method for returning your item/s, as Hoana is not held responsible for lost/ damaged returns in transit.

RETURNS - NOTE

- Returns received later then 14 days from delivery date, a 5.00€ processing fee will be deducted from your Store Credit Note.
- Returns received later than 20 days, will not be accepted & will be returned to the customer. Return delivery cost is paid by customer via Bank transfer before sending.

RETURNS - ASSESSING THE RETURN

- - Return product/s will be assessed upon arrival, to ensure it complies with our Returns policy.
- Non-returnable items &/OR returned items, which do not comply with our Returns Policy will NOT be accepted and will be return back to the customer. Return delivery cost is paid by customer via Bank transfe before sending.
- If you send shoes back with stickers and return labels directly on the box, or if the shoe box is damaged, we will not accept a return.

RETURNS - REFUNDS & PROCESSING TIMEFRAMES

- - Depending on the service & country you’re returning your item(s) with, it can usually take up to 14 working days ( excluding weekends & public holidays) to be delivered and processed by our returns team.
- Refunds will be issued to the same method of payment used to create the order.
- For payment made with both credit card and gift card/store credit, the refund will be applied to the gift card/store credit first
- Please do not email regarding the arrival of your return, unless it has been 15 days from receiving your return.
- You will be informed via the email address and in your Account page that you provided for your order, when this transaction is complete.
- Store Credit will be issued via Account or in the form of a voucher & remain valid for 1 year upon receiving it.
- Note- Hoana does not operate on Public Holidays, all returns will be processed the following working day.

RETURNS - WHAT CANNOT BE RETURNED

- For Safety/ Hygiene purposes, the following can not be returned:

- Jewelry (Any products within Jewelry category)
- Lingerie
- Swimwear (without a hygiene sticker)
- Sticky bras

RETURNS - CONDITION OF RETURN

All Garment/s must be returned:

- In Original condition, unworn & unwashed (Free of any stains from Makeup, deodorant/perfume, or wear)
- With all Tags attached & original packaging.

All Shoes must be returned:

- In original undamaged shoebox
- In the same condition, as delivered to you,
- Must be tried on indoors/ soft floor.

EXCHANGES - EXCHANGE FOR A DIFFERENT SIZE

Hoana Boutique offers exchanges for different size of the same product. Hoana Boutique covers exchange costs (processing, delivery cost...) for the first exchange, any other exchanges are at the expense of the customer.

EXCHANGES - EXCHANGE FOR DIFFERENT PRODUCT

A Store Credit will be issued, so you can re-purchase a new item.
If you need an urgent exchange, we would highly recommend that you purchase the replacement size prior to sending back the return, and we will issue you with a Store Credit, once we receive your unwanted item. (As we do NOT hold items nor exchange, while your item is being sent back).

LIMITATION OF LIABILITY

Customers must provide Hoana Boutique with complete and accurate details when making purchases. Hoana Boutique is not liable if we are given an incorrect delivery address at the time of purchase or returned goods. Any additional expenses in correcting the order are the responsibility of the customer.

Hoana Boutique provides care instructions for every product. Not following our care instructions may result in damaging the product. Hoana Boutique will in no way be liable for any damages caused by incorrect handling, including wrong or negligent use, care etc.

Hoana Boutique will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from use or inability to use the website or for the cost of procurement of substitute products or resulting from any products purchased or obtained or messages received or transactions entered into through the website or resulting from unauthorized access to or alteration of your transmissions or data or of any information contained on this website, including but not limited to, damages for loss of profits, use, data or other intangible, even if we have been advised of the possibility of such damages.

Where any Act of Parliament implies in the Terms and Conditions any term, condition or warranty, and that Act avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty shall be deemed to be included in the Terms and Conditions, however, the liability for us on any breach of such term, condition or warranty shall be limited, at our option, to any one or more of the following:

• if the breach relates to goods:
• the replacement of the goods or supply of equivalent goods;
• the repair of such goods;
• the payment of the cost of replacing the goods or of acquiring equivalent goods; or
• the payment of the cost of having the goods repaired; and
• if the breach to relates to services:
• the supplying of the services again; or
• the payment of the cost of having the services supplied again.

GIFT CARDS

Gift cards purchased through online are valid for 1 year from purchase date, can not be redeemed once expired.

INTELLECTUAL PROPERTY RIGHTS

All and any Intellectual Property Rights in connection with the Products shall be owned by Us absolutely.

TEXT MESSAGING AND TELEPHONE CALLS

Certain portions of the Services may allow us to contact you via telephone text messages. You agree that the Company may contact you via telephone or text messages including by an automatic telephone dialing system at any of the phone numbers provided by you or on your behalf in connection with your use of the Services, including for marketing purposes (including cart reminders and promotional offers). You understand that you are not required to provide this consent as a condition of purchasing any products. You also understand that you may opt out of receiving text messages from us at any time, by contacting us at service@hoanaboutique.com. After this, you will no longer receive text messages from us. If you want to join again, just sign up as you did the first time and we will start sending text messages to you again. Carriers are not liable for delayed or undelivered messages. If you do not choose to opt out, we may contact you as outlined in our privacy policy.

TERMINATION OF USER ACCOUNT

Company reserves the right to terminate your User Account for any reason including inactivity and at any time without notice to you. You have the right to terminate your use of the User Account by writing to the Company at the address provided at the end of these terms. Any termination of your use of the User Account, whether by you or the Company, will not affect any of your or the Company’s rights and obligations under these Terms that have arisen prior to the effective date of such termination.
